LM Radio Terms and Conditions

These Terms and Conditions constitute the entire agreement between you, the customer, and T&W Management Pty Ltd trading as LM Radio. If you use the LM Radio App, you accept and agree to comply with the most recent version of this agreement in its entirety. We reserve the right to amend this agreement or any parts thereof at any time and without notice. Amendments to this agreement take effect 24 hours after the agreement has been amended on the LM Radio App, and your continued use of the App implies your acceptance of the agreement as amended.

No hidden fees or buying obligations

There are no fees for registering on the LM Radio App.

Privacy Policy

Security Policy

We take security very seriously and this App is not vulnerable to unauthorised access. You agree to notify LM Radio immediately upon becoming aware of, or reasonably suspecting any unauthorised access to your App account and to take steps to mitigate any resultant loss or harm.

We value your privacy and all information about you and your account is handled in accordance with our Privacy Policy.

Age restrictions and age suitability

The onus is on you to ensure that you meet any age restrictions applicable to use of this mobile App accordingly, and you indemnify LM Radio from any and all liability in this regard, including any liability arising as a result of your failure to comply with any applicable age restrictions.

Competitions

Competitions will be subject to terms and conditions that will be provided during the time the competition runs.

Using and Accessing the LM Radio App

This App is for personal use only. You may not make use of content from this App, whether direct or derived, for any commercial purpose whatsoever. You may not frame or utilise framing techniques to enclose any content on this App without our express written consent.

Automatically Collected Information - Location. We collect and use precise location information from your device with your permission when you choose to use location-related features, like when you decide to share your location. There are certain settings relating to location-related information which you can find in your device settings or the in-app settings, such as location sharing. Even if you do not use our location-related features, we use IP addresses and other information like phone number area codes to estimate your general location (e.g., city and country). We also use your location information for diagnostics and troubleshooting purposes.

The following user information is collected and stored securely in our systems for as long as you are a member. 

First Name and Surname: This is stored and referenced to enable personalized communication between ourselves and you as the user. Provision is made for a username which is editable by you, that is used in the Messages section of the app as your profile identification.

Email: This is stored and referenced to enable a backup means of communication between ourselves and you as the user. It is also a security measure for ensuring recovery of an account if your cellular number changes or is lost.

Phone Number: This is stored and referenced as the primary means of registering and logging in to the app. This is the main method of identification and security via OTP delivery and is required.

Gender: This field is stored and referenced to allow personalized communication or offers and is an optional field.

Profile image: The option to upload a profile image is available should you elect to. This image will display with your username on conversation channels.

Any form of media (Images/Videos/Audio/Files) shared on the application/website are shared at your own discretion and made public where in the context to do so, such as public conversation channels. We reserve the right to remove any content deemed as inappropriate.

Disclaimer and limitation of liability

This App is provided "as is", and you use this App at your own risk. Neither LM Radio, its directors, employees, affiliates, agents nor suppliers shall be responsible for any damages or loss resulting from or relating to the use of this App or any of its content, irrespective of the cause of the damages.

We make no representations or warranties of any kind, whether express or implied.

We disclaim all representations and warranties including but not limited to the LM Radio App and its availability, the content of the App or the accuracy thereof for a particular purpose of information, goods or services.

Changes and acceptance of terms

We may change the terms at any time and where this affects your rights and obligations, we will notify you of any changes by placing a notice in a prominent place on this App or by email. If you do not agree with the change you must stop using the services. If you continue to use the services following notification of a change to the terms, the changed terms will apply to you and you will be deemed to have accepted such terms.

Waiver

Any favour we may allow you will not affect or substitute any of our rights against you.

Severability

If any term or condition is void (invalid), unenforceable or illegal, then the term or condition may be severed (removed) from and will not affect the rest of this agreement if it does not change its purpose.

Governing law

This agreement shall be governed by and interpreted according to the laws of the Republic of South Africa.
